EULA - End User License Agreement

The e Chromatic Tuner end user license agreement

By using the accompanying software, you consent to be bound by
and become a party to the licensing agreement specified below.

If you do not agree with ALL of the terms in the license,
please delete the distribution from your computer storage.

GRANT OF LICENSE

I, Keith Macleod, hereinafter “the artist formerly known as
Keith Macleod,” or “TAFKAKM,” hereby grant you a non-exclusive
license to use the Software distribution free of charge,
only in machine-readable form, and subject to the terms and
conditions of this Agreement. Title, ownership rights and
intellectual property rights in and to the Software and any
derivative works based thereon shall remain in and be the sole
and exclusive property of TAFKAKM.

LIMITED USE OF SOFTWARE

You MAY use the Software on any computer for non-commercial
purposes. You MAY NOT use the Software to derive commercial
value for yourself or for any commercial organization or
government agency without the prior written consent of TAFKAKM.
You MAY copy, duplicate or distribute the software, in its
original form, free of charge, provided this license and
accompanying documentation are included.

You MAY NOT rebrand or modify the software in such a way as to
remove the copyright attribution or obscure or alter its appearance
or origins. You may not decompile, reverse engineer, disassemble
(except to the extent specific laws explicitly prohibit such
restriction) or print the Software object code, in any form or
language, nor otherwise derive a source code for the software.
You may not modify, customize, enhance or change the Software,
nor permit any third party to do so. You may not make any derivative
works based on the Software. You may not change or remove any proprietary
markings, or labels in the software.

TERM OF LICENSE

The license granted under this agreement is automatically
terminated if you fail to comply with any of the terms in this
license. On termination, you must destroy all copies of the
software.

DISCLAIMER OF WARRANTY

This Software is provided free of charge and as such is provided
on an "AS IS" basis, without warranty of any kind, including
without limitation, the warranties of merchantability, fitness
for a particular purpose and non-infringement. You shall use the
software entirely at your own risk. To the extent allowed by law,
TAFKAKM expressly disclaims all implied warranties.

LIMITATIONS OF LIABILITY

UNDER NO CIRCUMSTANCES, LEGAL THEORY, TORT, CONTRACT OR IN NO EVENT
SHALL TAFKAKM BE LIABLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL
DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA,
LOSS OF USE OF COMPUTER HARDWARE, DOWNTIME, LOSS OF GOODWILL, LOSS
OF BUSINESS OR COMPUTER MALFUNCTION, NOR SHALL TAFKAKM BE LIABLE
FOR ANY DAMAGES, INCLUDING DIRECT, INDIRECT, SPECIAL OR
CONSEQUENTIAL DAMAGES, BASED UPON NEGLIGENCE OR STRICT PRODUCTS
LIABILITY.
